DATA PROTECTION NOTICE

1. PERSONAL DATA COLLECTED AND OBTAINED

This Data Protection Notice ("Notice") sets out the basis on which COLAISTE DE DANANN LTD T/A CENIT COLLEGE ("COLAISTE DE DANANN LTD T/A CENIT COLLEGE", “we”, "our" or “us”) of Unit 22 Tesco Monread Shopping Centre, Monread Rd, Naas, Co. Kildare, W91 YR12 will use the Personal Data you provided when applying for a Cenit College course (the "Application") This Notice details how COLAISTE DE DANANN LTD T/A CENIT COLLEGE will process your Personal Data for the purpose of providing and administering the Cenit College course you have selected.

The Personal Data provided by you will be held by COLAISTE DE DANANN LTD T/A CENIT COLLEGE as a controller. COLAISTE DE DANANN LTD T/A CENIT COLLEGE will collect and process the Personal Data that you provide throughout and after completing your Cenit College course (e.g., name, contact details, date of birth, logins to the Cenit College environment, IP Address, participation, progress, assessment, certification, outcomes etc.).

COLAISTE DE DANANN LTD T/A CENIT COLLEGE may also receive Personal Data about you from the Education and Training Boards (ETB), if applicable. The Personal Data, which is received consists of your name, address, email, phone, mobile, date of birth, gender, support required and employment support Group.

2. HOW AND WHY WE PROCESS YOUR PERSONAL DATA

This section details how ("legal basis") and why ("Purposes")we process your Personal Data:

Legal basis: it is necessary to process your Personal Data to enter into and perform our contract with you to provide Cenit College courses including for the following purposes:

  • to create your profile on the Cenit College environment, allowing you to access courses
  • to allow tutors, assessors and/or administrators to contact you to provide support and/or monitor your progress
  • to monitor and oversee your Cenit College course and to ensure the smooth running of your learner relationship with your tutor,
  • to monitor and oversee the performance of Cenit Colleges an online learning service and ensure the service continually improved;
  • to allow access to third-party applications which support your learning and certification, for example in undertaking practice tests,
  • to coordinate, take action (as necessary) and organise your Cenit College course; and
  • to respond to you when we receive any correspondence from you.

IMPORTANT: if you do not provide us with your Personal Data so that we can process it for the above purposes, we will not be able to proceed with your Cenit College course and/or communicate with you as necessary in relation to your enrolment and/or your Cenit College course.

3. DISCLOSURE OF YOUR PERSONAL DATA

We may disclose some or all of your Personal Data to the following parties: COLAISTE DE DANANN LTD T/A CENIT COLLEGE business units, ACCA, ILM, PeopleCert agents or service providers and government and state authorities including in particular the Department of Education and Skills.

We may also disclose your Personal Data to third parties if we are under a duty to disclose or share your Personal Data in order to comply with any legal or regulatory obligation or request or to perform a public function.

4. HOW LONG DO WE KEEP YOUR PERSONAL DATA FOR

We will keep your Personal Data for the duration of your Cenit College course and for a period of 2 years from when your Cenit College course terminates. Your data may be erased sooner as we see fit.  In some cases, we may need to retain your Personal Data for longer periods after you cease to be a Cenit College participant for compliance with legal obligations imposed on us or where we are a party to legal proceedings with you. Similarly, we may need to retain your Personal Data for longer periods after you cease to be an active Cenit College participant in order to meet the requirements of Awarding and Certification bodies. In each case, we will not keep your Personal Data any longer than is necessary in accordance with applicable law.

5. YOUR RIGHTS

This subsection sets out the rights which you have to address any concerns or queries with us about our processing of your Personal Data:

  • Right to Rectification
  • The Right to Withdraw Consent
  • Right to Erasure
  • Right to Data Portability
  • Right to Restriction of Processing
  • Right to be Object to Automated Decision Making

You can exercise any of these rights by submitting a request to the Data Protection Officer at dataprotection@cenitcollege.ie

We will provide you with information on any action taken upon your request in relation to any of these rights without undue delay and at the latest within one month of receiving your request. We may extend this by up to 2 months if necessary, however, we will inform you if this arises.

You have the right to lodge a complaint with the Office of the Data Protection Commissioner (21 Fitzwilliam Square South, Dublin 2, D02 RD28, Ireland) with regards to us processing your Personal Data.

6. CHANGES TO THIS NOTICE

We may amend this Notice from time to time, in whole or part, at our sole discretion. Any changes to this Notice will be effective immediately and you will be asked to accept before being able to log back into the learning platform.

If at any time we decide to use your Personal Data in a manner significantly different from that stated in this Notice or otherwise disclosed to you at the time it was collected, we will notify you by e-mail, and you will have a choice as to whether or not we use your information in a new manner.
